أثار القانون الفرنسي الأخير بمنع ارتداء النقاب ضجة كبيرة في مجتمعات المدونين في مختلف أنحاء العالم، لم يشر القانون الجديد – “ قانون منع تغطية الوجه في الأماكن العامة” – إلى النقاب بشكل مباشر ولكن أثره بالكامل ينعكس على الإسلام والمسلمين.

ناقش بعض المدونين الآسيويين هذه القضية.

بنجلاديش

قدم صادق علام من مدونة Technology Of The Heart (تكنولوجيا القلب) خلفية بسيطة عن منع تغطية الوجه في فرنسا والقانون الصادر في 2004 بمنع ارتداء أي ملابس أو رموز دينية في المدارس العامة:

«النص الأصلي:Majority of Islamic scholars agree on the point that Full Face Veil is NOT something which is a requirement of Islam or mandatory to observe (even though some observe it believing it as part of their religious observation). Many Muslim leaders have said they support NEITHER the veil nor the ban. [..]

Thanks to various culture from where people came and accepted Islam, various pre-existing dress code and idea of modesty became part of Muslim culture and they must be viewed as cultural element than religious. Dressing modestly is possible independent of culture, race, or existing practices of any other land or nation.»

«ترجمة:أغلب علماء المسلمين متفقون على أن تغطية الوجه ليس فرضاً (برغم أن البعض ينفذونه إيماناً بكونه جزءً من طاعتهم لله). كما أن العديد من الزعماء المسلمين لم يؤيدوا لا النقاب ولا منعه.

نتيجة لتعدد الخلفيات الثقافية للمسلمين فقد أصبحت العديد من تقاليد الملبس ومفهوم الحشمة السابق على الإسلام جزء من ثقافة المسلمين، ولابد من النظر لهذه الأمور كرموز ثقافية لا دينية. فالاحتشام ممكن بعيداً عن أي ثقافة أو عرق أو أي ممارسات سائدة في أي أرض أو شعب.»

وعلق على القانون الفرنسي بمنع النقاب قائلاً:

«النص الأصلي:While its understandable that full face veil is not necessarily a religious obligation from Islamic point of view, but an age old cultural practice, yet banning it creates a very different situation for it. From the point of individual freedom this becomes some what disturbing. A state or country telling its citizen what to wear and what not to wear contradicts with democratic, civil values – the very values French republic so high upheld.»

«ترجمة:مفهوم أن النقاب ليس بالضرورة فرض إسلامي بل رمز ثقافي، ولكن قرار منعه يضعه في موقف مغاير تماماً، فالأمر مقلق من منطلق مفهوم الحرية الشخصية، فحين تملي الدولة على مواطنيها ما يجب عليهم ارتداؤه فهذا يتناقض مع المبادئ الديمقراطية والمدنية، تلك المبادئ التي رفعتها الجمهورية الفرنسية عالياً.»

بوتان

أخذت الصحفية والمدونة ديبيكا العديد من الاعتبارات في حسبانها ثم كتبت:

«النص الأصلي:Perhaps there are women who want to be freed of wearing a veil at all times throughout their lives- and are secretly happy that now they can.

But on thinking about this for a while, I come to the conclusion that this law is still wrong. Because my leaning towards this law is based on the assumption that the women actually don't want the veil, but are being forced into wearing it by their men. But this is an assumption. I am sure there are a lot of muslim women in France. Some may not want to wear the veil, but are being forced to by their family. Some, however inconceivable it may seem to us, may want to wear it! And if a single woman in France wants to wear a veil, she has every right to do so. Having a law that denies her this right is wrong.»

«ترجمة:ربما بعض النساء يردن التحرر من ارتداء النقاب طوال الوقت وسررن بما حدث في صمت.

ولكن بعدما فكرت في الأمر قليلاً وصلت إلى أن هذا القانون لا زال يمثل غلطة، فميلي لهذا القانون مبني على افتراض أن النساء يرفضن النقاب وأن أزواجهن يجبرونهن عليه، ولكن هذا افتراض، أنا واثقة أن هناك العديد من المسلمات في فرنسا، بعضهن يرفضن النقاب وعائلاتهن تجبرهن عليه، ولكن ربما يريد بعضهن أيضاً ارتداءه حتى لو لم يكن هذا مفهوماً بالنسبة لنا، ولو أرادت إمرأة واحدة في فرنسا أن ترتدي النقاب فلها كل الحق في هذا، وجود قانون يحرمها من هذا الحق هو غلطة.»

وتصل في النهاية إلى:

«ترجمة:أي قرار منع ينال من حريتك الشخصية هو غلطة، منع النقاب في فرنسا ومنع تجارة التبغ في بوتان.»

باكستان

رازا جبيب كتب في Pak Tea House (بيت الشاي الباكستاني):

«النص الأصلي:The ban opens a whole new philosophical debate on concepts like religious tolerance, freedom, the meaning of secularism and even liberalism. It is the ongoing debate between those who take liberal and secular positions which interests me and there is a lot of merit in discussing the issue in liberal and secular context. [..]

Secularism has to blend in with religious freedom and tolerance and only then it can be a true liberal version of secularism. The French brand of secularism will not make the concept of secularism popular and will not work in a pluralistic society. It will rather defame and further intensify the confusions surrounding the concept of secularism.»

«ترجمة:أثار قرار منع النقاب جدلاً فلسفياً حول بعض المفاهيم مثل السماحة الدينية والحرية ومعني العلمانية وحتى الليبرالية. يهمني الحوار الدائر بين أصحاب الآراء الليبرالية والعلمانية فالأمر يستحق مناقشته في هذا الإطار.

لابد أن تنسجم العلمانية مع الحرية الدينية والتسامح الديني، حينها فقط ستصبح علمانية ليبرالية حقيقية، التطبيق الفرنسي للعلمانية لن يساهم كثيراً في نشر مفهومها ولن يفلح في المجتمعات متعددة الأطياف والتوجهات، بل سيعمل على تشويه صورتها وزيادة الخلط الحادث في مفهومها.»

و يأمل صاق في ختام هذا النقاش أن يكون لهذا القانون أثراً إيجابياً:

«النص الأصلي:The sum effect of banning of Burqa most probably going to have positive effect because it encourage integration, it forces even Muslims (in Europe they have tendency to live in their own bubbles) to understand their own customs, educate themselves and separate cultural baggage from authentic teachings or practices. This also offers opportunity for Muslims to educate non-Muslims about their beliefs and the fact that those who practice Islam do not belong to a Mono-Culture.»

«ترجمة:في الغالب سيحدث قرار منع النقاب أثراً إيجابياً لأنه سيشجع عملية الاندماج، وسيدفع المسلمين أنفسهم (لدى المسلمين في أوربا ميل للعزلة) إلى فهم تقاليدهم والتعلم وفصل العادات الثقافية عن التعاليم والممارسات الدينية الحقيقية، كما أنه سيتيح لهم الفرصة لتعريف غير المسلمين بمعتقداتهم وحقيقة أن الممارسين للشعائر الإسلامية لا ينتمون إلى ثقافة واحدة.»
